North Dakota's DUI Penalties Are Serious

North Dakota, like most states, classifies drivers as intoxicated when their blood alcohol concentration (BAC) is at least .08 percent. If the driver is under 21, North Dakota has a zero tolerance policy for those individuals with .02 BAC or higher.

The penalties for a conviction will hinge on the number of offenses a driver has and what their BAC was. The general guidelines for DUI penalties are:

  • First offense: This is a Class B misdemeanor carrying $500-$750 in fines, 91-180-day license suspension and a possible two-day jail sentence.
  • Second offense in seven years: There may be a 10-day jail sentence, up to $1,500 in fines and one to two years of license suspension.
  • Third offense in seven years: The third offense is a Class A misdemeanor carrying up to 120 days in jail, a $2,000 fine and a two to three years of license suspension.
  • Fourth offense in 15 years: This is a Class C felony that can result in a one-year jail sentence, $2,000 in fines and two years of supervised probation.

Defending You During The DOT Hearing

After a DUI arrest, the Department of Transportation may begin moving to restrict your driving privileges. It is critical to make a formal request for an administrative hearing within 10 days of the arrest. Failing to act with this time window could lead to a license suspension or revocation that you will not be able to overturn.

After submitting the request, the hearing will likely take place within 25 days of the initial arrest. During these hearings, the DOT will seek to prove that you were driving while intoxicated. You can have a lawyer present to advocate for your rights and your interests.
